When the CMR convention applies
  • The CMR convention is one of the key documents regulating road transport. Many courts base their rulings on its provisions. However, it is important to clearly distinguish when it applies — it only concerns transport between different countries. For transports carried out within a single country, national law applies.
Carrier's liability and compensation
  • The CMR convention offers a range of options for protecting goods — from the moment they are taken by the carrier until unloading. According to Article 23, there is a possibility of claiming compensation from the carrier. Depending on the type of breach, this may be a specific amount of the claim, but not exceeding the amount of freight. In cases where additional costs or customs fees have arisen, these can also be claimed for reimbursement.
Transport delays and complaints
  • In the case of delays in international transport, there is a possibility to file a complaint. According to the CMR convention (Article 30, point 3), this must be done in writing within 21 days. From the moment the goods are delivered, we have 21 days to prepare the complaint letter. It should be sent by mail and additional forms of communication, such as email or fax. It is also good practice to note the delay on the CMR copy.
Damage to goods – what is crucial
  • If damage to the packaging or goods is visible upon receipt, it should be immediately noted in the CMR document. Otherwise, pursuing a claim may be significantly hindered or impossible. Hidden damages or shortages can be reported in writing within 7 working days. After this period, pursuing claims may only be possible through legal means.
